Article (3)
Aims of the Law
This Decree-Law aims as the following:
1. Regulate and develop transplantation operations, preservation, and transferring of human
organs and tissues.
2. Ban human organs and tissues trafficking.
3. Protect rights of persons who receive (recipients) and persons who donate (donors) human
organs and tissues.
4. Regulate the process of donating human organs and tissues.
5. Prevent the exploitation of patient's or donor’s needs.
Article (4)
Licenses
The operation of transferring or transplanting a human organ or part thereof or tissues is only
allowed to be performed by specialized physicians in the medical facilities licensed by competent
health authorities, and the executive regulations of this Decree-Law provides for the licensing
conditions and procedures.
Article (5)
Prohibitions
The following is prohibited:
1. Buying or selling the human organs or parts thereof or tissues by any means whatsoever or
through receiving any return for that.
2. Performing or taking part in the operation of transferring or transplanting a human organ or
part thereof or tissue if such surgeries violate this Decree-Law.
3. Making propaganda, advertisement, promotion or brokerage for unlicensed operation of
transferring or transplanting a human organ or part thereof or tissue.
4. Financing the operation of transferring or transplanting a human organ or part thereof or tissue
if it is known that the donation was made in return for money
Article (6)
Costs of Human Organs and Tissues Transplantation Operations
The Health Facilities and their staff are prohibited to receive any amounts of money exceeding the
actual costs of services provide by such facilities and stuff for performing the operation of
transferring or transplanting a human organ or part thereof or tissue in accordance with the
decisions of the competent health authorities in this regard.
*In case of any misinterpretation, the Arabic version of this legislation prevails.
