Article (14)
Reversing the Donation
The donor may change his mind before removing an organ or part thereof or tissue. However, he/
she may not recover a donated organ once it is removed in accordance with the provisions of this
Decree Law.
Chapter 3
Transferring Organs and Tissues from the Deceased
Article (15)
Terms of Transfer After Death
Any organ or part thereof or tissue may be transferred only when the following requirements are
fulfilled:
1. Transfer shall be made only after proving the death.
2. Death shall be proven by a committee composed of three specialized physicians, one of
them is specialized in nervous diseases, provided that the surgeon in charge of performing
the organ and tissue transfer operation, owner or a partner of the health facility in which
the operation is carried out shall not, at the time of preparing the medical report, be a
member of the committee.
3. The donor has not, while he/ she was alive, expressly declare his/ her rejection to donate
his organs or tissues.
4. He/ she has declared his desire to donate in accordance with the provisions of Article (16)
hereof, failing which, a consent provided for in Article (17) hereof shall be obtained.
5. Transfer shall be made in a manner taking into account not to abuse the corpse.
Article (16)
Registering Decision of Donation After Death
Any person meets the eligibility requirements may declare his desire whether to or not to donate
an organ or part thereof or tissue after death. Moreover, he/ she may unconditionally backtrack on
his/ her decision at any time, provided that he/ she shall register this desire in the identity card or
any other documents, in accordance with the Executive Regulation of this Decree Law.
Article (17)
Terms of Organ or Part thereof or Tissue Transfer from Deceased Person that Never
Expressed the Desire to Transfer
It is a precondition for the transfer of an organ or part thereof or tissue from the body of a deceased
who did not declare, while he/ she was alive, his/ her desire in writing whether or not to donate, to
