obtain the consent of any of his/ her relatives who enjoy full legal capacity and residing in the
Country at the time of his death, according to the following order:
First: Father
Second: Elder son
Third: The only son residing in the Country.
Fourth: Grandfather
Fifth: The eldest of siblings, then elder half-brother, if there is no sibling
Sixth: The only son residing in the Country
Seventh: Agnatic Uncle. The full uncle shall be prioritized over the parental uncle
Eighth: Either of the spouses, if the deceased’s agnates as per the above-mentioned order are not
known.
Article (18)
Non-disclosure of the Donor or Recipient Identity
The recipient shall not be informed of the identity of deceased donor, his/ her family members or
relatives. Moreover, the deceased donor’s family shall not be informed of the identity of the
recipient, his/ her family members or relatives.
Chapter 4
Penalties
Article (19)
Imposing the penalties provided for herein shall not prejudice the imposition of severer penalties
provided for in any other law.
Article (20)
Whosoever sells, buys, offers selling or buying, or mediates in selling or buying a human organ or
part thereof or tissue shall be penalized by imprisonment and fine not less than thirty thousand
Emirati Dirham (AED 30,000) and not exceeding one hundred thousand Emirati Dirham (AED
100,000).
Article (21)
Whosoever trades or mediates with the intention of trafficking in human organs or part thereof or
tissues shall be penalized by imprisonment for a period not less than five (5) years and not
exceeding seven (7) years and a fine not less than five hundred thousand Emirati Dirham (AED
500,000) and not exceeding three million Emirati Dirham (AED 3,000,000).
The court shall order the seizure of funds derived from the crime.
